Disciplinary Policy

The purpose of this policy and related procedure is to ensure that students receives
learning in an environment that respects and values the dignity of individuals, is free
from discrimination or harassment and has fair and equitable processes for dealing
with student complaints and appeals. To this end EAA wishes to ensure that our
students and staff respect each other when involved in training and have set some
rules.

The following rules apply for an individual’s involvement with our education and
training services:

Drugs and Alcohol
Use of narcotic drugs and/or alcohol on EAA’s premises is prohibited and any
student(s) believed to be under the influence of these substances will face disciplinary
action.

Smoking
EAA maintains a smoke-free environment. Smoking or the use of prohibited or illegal
substances at training sessions or on EAA’s premises, or within 5 meters of EAA premises,
is prohibited.

Disruptive behaviour
Persistent disruptive or hostile behaviour inside the classroom or anywhere on the
campus will not be tolerated. Fighting, physical assault, or behaviour which is perceived
to be threatening to any person whatsoever whilst on EAA’s premises is not permitted.

Language
Foul or abusive language affecting EAA staff or fellow students will not be tolerated and any
participant using such language will be asked to leave the training session immediately.
During training sessions students and staff must use the English language only. At all other times,
while on EAA premises, the use of English language by all staff and students is strongly recommended.

Dress Code
Participants are expected to attend any training session suitably and safely attired. Unless otherwise advised,
only smart casual dress will be accepted. Correct footwear is required on EAA premises – no thongs, sandals
or open-toed footwear is allowed in rooms which are designated as simulated workshop or demonstration areas.
When entering kitchens or automotive workshops the regulation safety footwear must be worn. During practical
classes all jewellery, including bangles, bracelets or rings, must be removed.

Harassment & Discrimination
Harassment or discrimination of any kind, whether verbal, sexual, physical,
psychological or behavioural will not be tolerated.

Equipment & Materials
Students will respect EAA’s equipment and materials or face disciplinary
action/penalty fees for deliberate misuse of such equipment or materials.

Dangerous Articles
Carrying, using or being in possession of a prescribed or regulated weapon or
dangerous articles on EAA’s premises is prohibited.

Mobile Phones
Students may not use mobile phones on EAA campus buildings except in specific,
designated mobile phone friendly zones such as reacreation areas or student dining areas.

Theft
Theft from EAA, staff or students will be dealt with in accordance with the Law.

Arson, Wilful or Malicious Damage
Arson, wilful or malicious damage to EAA’s property or equipment is not permitted.

Such activities will be penalised by way of fines/ required replacements/ legal actions. 

Consequent actions for policy breaches
EAA will undertake disciplinary action should an individual be engaged in any inappropriate or improper behaviour whilst on EAA premises. Any student(s) found to be in breach of this policy will be asked to leave the training session or premises immediately. Our staff will make a written report of the incident, which will be lodged on the student’s file at EAA and appropriate action will be taken. Return to classes will be contingent upon satisfactory commitment from the student(s) to refrain from further such incidents. Further breaches will lead to withdrawal from classes and EAA.

These rules are in place to ensure the best possible learning environment for our participants and a safe and positive workplace for our staff. These rules are not negotiable and if broken will be enforced. Any individual not following the above rules will be removed and may be jeopardising their future involvement in any further training.

Sources of evidence could be eye witness accounts, complaints/reports from staff members, visitors, students or video recordings from the video surveillance system.

The video surveillance system will be used in accordance with the Code of Practice for Video Surveillance.

Any criminal conduct will be reported to the appropriate authority. Should EAA deem it necessary, students found to be behaving consistently against EAA Displinary Policy could have their enrolments suspended/ cancelled on disciplinary grounds. 

Language, Literacy and Numeracy

EAA recognises the importance of basic skills in English language, literacy, and numeracy (LLN) for students in being able to participate actively and effectively in any course of study. Improving basic skills will assist in breaking down barriers facing students in communicating with their trainers, peers and in the workplace. To achieve this, EAA will ensure that all participants enrolled in our vocational training courses are given the opportunity to learn based on their individual competencies in LLN. Based on this EAA will identify further vocational training or educational needs and where possible, tailor training programs to suit individual needs. Access and Equity

E.A.A. has legal obligations under State and Federal equal opportunity law, the Technical and Further Education Act, 1976 and the Occupational Health, Safety and Welfare Act, 1986 to ensure that the working and teaching practices are fair and equitable. Employees and students are provided with a non-discriminatory, safe and healthy working and learning environment. This means, E.A.A. will endeavour to provide a working and learning environment free from discrimination and/or harassment. Harassment

Harassment of any kind, be it sexual, physical or verbal will not be tolerated at E.A.A. Any person found harassing others will be asked to leave the training session immediately. Return to classes in any of these circumstances mentioned above will be contingent upon satisfactory commitment from the student to the General Manager of E.A.A. and to other students to refrain from such further incidents. Further breaches will lead to withdrawal from classes and E.A.A.

Complaint Policy

If a disagreement or dispute occurs between a student and any member of staff, the student should speak to the staff member and make an attempt to discuss the matter calmly and come to a better understanding of the situation and its causes. If a solution to the problem cannot be found, a higher authority or an external mediation service will be consulted. A chart outlining the steps to take if you, as a student, have a complaint or are in a dispute, is displayed in every classroom and a copy of the same can be obtained from your Student Services office.

Appeal Against Assessment

If you are dissatisfied with the result of assessment for any unit(s) you may appeal against assessment by first talking to your trainer about the matter. If the matter remains unresolved you may lodge a formal appeal by submitting an Appeal Against Assessment Form, available at the Student Services Office. Please attach any relevant copies of assessment/ coursework to your appeal.

Complaint Recording Procedure

We keep records of the complaints in the form of reports including details of the parties involved and the steps that were taken to resolve the problem. At E.A.A., we also provide a suggestion box facility through which suggestions, complaints or other comments can be voiced.

Revised Under - 18 Student Recruitment Policy

We will not recruit any students who are under the age of 18 at the time of the commencement of the course. However, they may start their admission procedures while they are not yet 18, but they must complete 18 years of age at the time of arrival into Australia as well as at the commencement of the course. 

We will continue to discharge our responsibility towards currently enrolled students who are under 18 years of age, as per our old policy and duty of care, until they attain majority.
